Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Instastatistics ("InstaDownloader", "we", "us", "our") governing your access to and use of https://downloader.instastatistics.com (the "Service"). By using the Service you accept these Terms in full. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you must have the consent of a parent or legal guardian.

2. Service description

The Service helps users retrieve publicly available Instagram media (posts, reels, photos, carousels, stories, profile pictures, IGTV, audio) by accepting an Instagram URL or username and proxying the original CDN file. We are an independent third party. The Service is not affiliated with, endorsed by or sponsored by Instagram or Meta Platforms, Inc.

3. Acceptable use

You agree not to use the Service to:

• Access content from private or protected accounts you do not have permission to view.
• Download, distribute or repost content in a way that infringes intellectual property, privacy, publicity or other rights of any third party.
• Republish, mirror, monetise or commercially exploit downloaded content without explicit permission from the rights holder.
• Send automated, abusive or excessive volumes of requests, attempt to bypass rate limits, or interfere with the integrity or performance of the Service.
• Use the Service for harassment, doxxing, defamation, misinformation, spam, malware distribution or any unlawful activity.
• Reverse engineer, scrape or otherwise extract source code, internal APIs, or non-public infrastructure of the Service.

4. Intellectual property

All Instagram content remains the property of its original creator and/or Meta Platforms, Inc. The Service does not transfer any ownership rights. You are solely responsible for ensuring that your use of any downloaded content complies with applicable copyright law and the original creator's wishes. The Service's own UI, code, branding and aggregate metadata are the property of Instastatistics.

5. DMCA and takedown

We respond to valid DMCA takedown notices and equivalent international requests. To request removal of cached metadata or to report infringement, email dmca@instastatistics.com with: (a) your contact information, (b) identification of the work claimed to be infringed, (c) the URL of the cached item, (d) a good-faith statement, (e) a statement under penalty of perjury, and (f) your physical or electronic signature.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR NON-INFRINGEMENT. We do not guarantee that any specific download will succeed, that the Service will be uninterrupted, or that cached content reflects the current state of Instagram.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTASTATISTICS, ITS OFFICERS, EMPLOYEES, CONTRACTORS AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED USD 100.

8. Indemnification

You agree to indemnify and hold harmless Instastatistics from any claim, loss, liability or expense (including reasonable legal fees) arising out of your breach of these Terms or your misuse of any content obtained through the Service.

9. Third-party services and links

The Service relies on third-party providers (Instagram CDN, upstream metadata APIs, Google AdSense, Google Analytics, Microlink, Cloudflare). We are not responsible for the content, availability or practices of third parties. Your interactions with them are governed by their own terms.

10. Advertising

The Service is supported by advertising via Google AdSense. By using the Service you consent to being shown advertising consistent with applicable consent frameworks. We do not personally endorse advertised products or services.

11. Termination

We may suspend or terminate access to the Service, in whole or in part, at any time and for any reason, including suspected violation of these Terms or applicable law. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will survive.

12. Changes to the Terms

We may update these Terms from time to time. The "Last updated" date will reflect the most recent revision. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing law and venue

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-laws principles. Disputes arising out of or relating to the Service will be brought exclusively in the competent courts of Amsterdam, The Netherlands, except where mandatory consumer-protection law in your jurisdiction provides otherwise.
